Art. 1Definition, Objectives and Terms of UseUnder the name of Community Fund for Sustainable Development, a fund has been created for the purpose of promoting sustainable development by the City of Lausanne in compliance with Art. 2 and 73 of the Federal Constitution. This fund is intended: A. for financing actions supporting sustainable development in relation to Municipality projects in the following areas:a) measures aimed at promoting wood, lowering the cost of projects using native wood, pilot projects having to do with the usage of wood, total or partial financing of industries in which the community is involved, allowing for a distinct increase in native wood used by the economy and public powers within our region; b) measures regarding energy which can not be supported by the Community Fund for the Rational Use of Electricity and the Promotion of Renewable Energy; c) measures aimed at maintaining agricultural spaces in the Lausanne area and at renovating farms belonging to the city; d) construction of buildings designed under the Diane standard or other standards related to sustainable development; e) measures allowing for the financing of public park maintenance or the creation of green areas, particularly when re-zoning city land; f) measures aimed at maintaining and restoring the architectural and natural heritage of the City as well as planting large trees on Lausanne land; g) studies concerning statistical indicators that make it possible to evaluate the status of sustainable development in the Lausanne region and specifically in the city of Lausanne; h) studies and pilot projects for the Municipality concerning future steps in the implementation of sustainable development, particularly by taking into account the concept of grey energy; i) monitoring of indicators of sustainable development, particularly environmental indicators, conforming to the principle that the polluter pays; j) actions designed to keep people informed about the objectives of sustainable development; k) advice and measures aimed at maintaining healthy living in residences; l) financing actions aimed at a better integration of residents within neighbourhoods; m) financing activities for getting people involved, particularly in the Lausanne neighbourhoods; n) financing studies in social services and housing that are related to the implementation of Lausanne’s Agenda 21; o) studies concerning a better distribution of responsibilities between the community and the region; p) studies aimed at improving efficiency within the administration, as well as analyzing various services in terms of their cost and usefulness; q) development of sports and culture for all as an integration factor; r) actions designed to educate children and parents on how to stay physically and mentally healthy from childhood through adolescence; s) measures creating better social integration by means of education and access to education; t) measures aimed at encouraging youth participation in art and city life; u) financing Lausanne’s participation in organizations and international networks that deal with cities and the criteria for sustainable development; v) supporting projects opposing the negative effects of globalization; w) studies, work, or information campaigns concerning soft mobility or non-conventional public transportation systems in the City of Lausanne; x) measures supporting the moderation of traffic and pedestrians; y) professional training assistance for Lausanne’s youth; z) assistance for the establishment of businesses on Lausanne’s land whose business activities are environmentally or socially responsible; aa) measures aimed at increasing safety and reducing the feeling of a lack of safety among residents; ab) supporting actions related to city marketing for the City of Lausanne insofar as they have something to do with sustainable development;

B. for generating and supporting (via subsidies) measures and projects that are also classified as sustainable development, as defined in section A, letters a) to e).Art. 2FinancingFunding is supplied by the following amounts: a) 0.15 cent per kWh sold on the electricity distribution network; b) 0.05 cent per kWh on the sale of gas, gas services, and remote heating; c) 2 cents per m3 on the sale of water and water services; d) 1% of the annual profits of industrial services.
Art. 3Upon request by the city administration services or its own leader, the Municipality may decide to allocate amounts less than or equal to 100,000 francs from the sustainable development fund. Once a year, it will inform the City Council of all disbursements made under this criteria, during the municipal accounting. For expenses ranging between 50,000 and 100,000 francs, it will immediately inform the City Council. Art. 4For any expense that would lead to more than 100,000 francs being deducted from the sustainable development fund, the Municipality shall serve the City Council with a notice. Within the framework of notices served to the City Council, it may also request that a portion of an expense wholly or partially pertaining to sustainable development be added to the sustainable development fund. Art. 5No withdrawal from the sustainable development fund may occur without agreement from the Municipality (for amounts less than or equal to 100,000 francs) or the City Council (for amounts greater than 100,000 francs). In the event that the sustainable development fund contains more than 20 million francs, its financial funding will be suspended temporarily. Art. 6Restitution of subsidiesThe term of limitation is 5 years for reimbursing unduly received subsidies or those obtained by tricking or defrauding the authorities. Art. 7In the event of dissolution of the fund, the City Council will decide how the remaining money will be allocated, following proposals by the Municipality. Effective DateThis regulation becomes effective 30 days after it is accepted by the City Council, with the exception of Article 2, which becomes effective on 1 January 2001, and within Article 2, letter d), which affected industrial service accounts in 2000. |
